EU Data Act

Our Approach to the EU Data Act

The EU Data Act (Regulation (EU) 2023/2854) introduces new rights and obligations for providers of data processing services who provide their services to customers in the European Union. At Samsara, we welcome these rules and are committed to helping our EU-based customers exercise their rights in a fair, transparent, and compliant way.

Scope of Application

The EU Data Act applies only to contracts and customers that fall within the territorial scope of EU law. It does not apply to customers outside the EU, including those in the United Kingdom, unless expressly agreed otherwise.

Termination Rights

From 12 September 2025, EU customers have a right to terminate certain contracts for convenience under the EU Data Act. We respect this right to the extent a customer has such a right and have therefore updated our terms for EU customers to address such a right accordingly. 

Early Termination Fees

Where an EU customer chooses to terminate a fixed-term agreement early, we apply a proportionate early termination fee:

  • Not a switching fee: Our early termination fee is never a “switching charge” under the EU Data Act.

  • Transparent: The fee is calculated by reference to the remaining charges under the contract, and clearly set out in advance.

  • Fair: The fee ensures balance. EU customers can exit if needed, and we are compensated for the agreed commitment.

Switching & Portability

We support EU customer choice and comply with the EU Data Act’s switching provisions.

This includes:

  • providing Customer Data in a structured, commonly used, and machine-readable format; and

  • the ability for customers to export their data to use our dashboard's export features or the Samsara API at any time during their contract with us.
