Biometric Data Retention and Destruction Policy

Background

Camera ID is Samsara’s only feature that leverages face recognition technology, and is used to facilitate driver assignment, enabling accuracy and efficiency in route assignment and organization, and driver coaching. 

Because the scope of what constitutes biometric data under various jurisdictions’ laws has not yet been resolved, it is possible that individuals may assert that Camera ID collects, uses and stores information that qualifies as biometric data under a particular jurisdiction’s laws. Samsara’s customers are responsible for compliance with applicable law governing any collection, storage, use, and/or transmission of information through their use of Camera ID, including but not limited to, obtaining any required consents from drivers. Samsara views such measures as the responsibility of its customers, not Samsara.

Samsara includes the term “biometric data” throughout this policy in an abundance of caution given the unsettled and evolving legal requirements. Samsara’s use of the term “biometric data” within this policy does not reference any particular legal definition of that term.  

The information provided in this policy is not intended to be legal advice or a substitute for legal advice, and does not nullify or modify our customers’ legal or contractual obligations.  It is the sole responsibility of Samsara’s customers to determine if applicable data protection and biometric privacy laws apply to the customer’s use of Samsara’s products and services and to take any necessary steps to comply with such laws. 

Camera ID

By combining dash cam footage and advanced machine learning, Samsara’s optional Camera ID feature can learn to assign drivers automatically if a customer obtains legally required consent from its drivers and activates the feature. Our customers control the installation of Samsara dash cams in their vehicles, and control which drivers use dash cam-equipped vehicles.  

The face recognition technology leveraged by Camera ID collects, uses, and stores face information that individuals may assert qualifies as biometric data under applicable law. Information used by Camera ID is never disclosed other than for the limited purposes described in our Terms of Service and at all times in compliance with applicable law. The face recognition technology is used only to assign drivers to vehicles, trips, and safety events in the Samsara dashboard for a specific organization. Retention/Destruction

Our customers control their employees’ data. Customers are required to deactivate a driver in the Samsara dashboard when that driver leaves the customer’s employment. Our customers’ employees should direct any request to delete information used by Camera ID outside of the parameters specified below to their employer to communicate with Samsara. 

Driver Specific Data

Driver-specific information used by Camera ID will be retained until 90 days after the customer either deactivates the driver from its Samsara account or disables Camera ID, at which point such information, including any information that may constitute biometric data, will be permanently deleted. 

Organization Level Data

Organization-specific information used by Camera ID will be retained until 90 days after the customer disables the Camera ID feature, at which point such information, including any information that may constitute biometric data, will be permanently deleted.
